An innocent man on Texas Death Row

Mr. Robert Will is currently on Death Row in the State of Texas at The Polunsky Unit.

Mr. Will’s case is at a very critical stage. On March 30th, 2010 a hearing will be held in the Federal District Court concerning Mr. Will’s appeal. This very well may be the last meaningful court hearing he will have.

I have done an extensive amount of pro bono investigation work on Mr. Will’s case although I cannot officially represent him because I am not licensed to practice criminal law. I have practiced civil law for over 20 years but have never focused exclusively on criminal defense cases. The investigative work I have done concerning Mr. Will’s case has led to obtaining the hearing in March.

It is imperative that we raise enough funds to pay for an experienced Criminal Defense Attorney to represent Mr. Will at the hearing in March. The work I have done on Mr. Will’s case has cost approximately $9,000 in out of pocket expenses. If the time I have spent working on Mr. Will’s case were to be billed at a minimal hourly rate the cost would be between 20-30 thousand dollars. I have done all of this work without pay, using my own funds for expenses.

Furthermore, I spent approximately $22,000 working on Kenneth Foster’s case (approximately $60,000 in billable hours). Mr. Foster was sentenced to Death Row through the Law of Parties, and in August of 2007 was won a Life Sentence. I am the Attorney who filed Mr. Foster’s clemency petition and spoke on his behalf at his Board of Pardons and Parole Paroles clemency hearing. The petition was approved by the Board and forwarded to Governor Rick Perry. Governor Perry granted the petition and Kenneth Foster’s life was saved.

Now funds need to be raised to save Mr. Will’s life. I am willing to do further investigation as funds permit but money needs to be raised to pay for a Capital Defense Attorney to represent him. Several good attorneys have said that they may be willing to accept Mr. Will’s case for a starting fee of 20-30 thousand dollars. That is a large sum of money but if 1,000 people donate $30 the initial goal will be achieved.

I would like to urge everyone to make a donation today. Urge others to donate as well. In reviewing Mr. Will’s case I have discovered substantial evidence that points toward his innocence. Mr. Will deserves a fair hearing with representation by a competent Attorney who will advance his lawful legal goals and objectives.

Although I am certain Mr. Will would have no interest in using funds for anything other than legal expenses, anyone who may be concerned with “sending money to a prisoner” should be aware that Mr. Will has no direct control over his Defense Fund. The Fund is managed by Ms. Johnson, the Chairperson of Mr. Will’s Defense Committee. Ms. Johnson is a completely trustworthy individual. She has been involved in social work for over a decade and I have known her for many years.

Once again, I would like to urge everyone to make a donation today and help save Mr. Will’s life.
